SUMMARY OF FUNCTIONS, RESPONSIBILITIES, POWERS AND ORGANIZATIONAL STRUCTURE OF THE NATIONAL AGRO-FORESTRY-FISHERIES QUALITY ASSURANCE DEPARTMENT (NAFIQAD) (29/04/2011)

Function and Duty
The National Agro-Forestry-Fisheries Quality Assurance Department (hereinafter referred to as NAFIQAD) is an institution assisting the Minister to carry out the state governing of quality and safety of agricultural, forestry, fishery products and salt nation-wide.
NAFIQAD has its own seal and is permitted to open an account at the Bank and the National Treasury.
NAFIQAD has its headquarters in Hanoi.

Responsibility and Power
1. Elaborate and submit to the Minister drafts of laws, ordinances, strategies, legal documents in the framework of the annual programs and plans of the Ministry and other schemes, projects assigned by the Minister. Submit to the Minister drafts of Decisions, Directives and other documents belong to the competence of the Minister.
2. Propose and submit to the Minister strategy, long-term master plan, five-year or annual plans; strategies for key zones, inter-zones and inter-provinces and other significant programs, projects and works belong to the responsibility assigned by the Minister.
3. Issue specific documents and relevant professional guidance. Inform the plan of programs, titles, projects managed by the Ministry to related provinces and institutions after being approved by the Ministry regarding assigned fields.
4. Submit to the Minister the developing strategy and master plan and instruct, guide and supervise the implementation of approved legal documents, strategy, master plan, programs, projects, schemes, standards, technical regulations, procedures, practices,…; instruct and propagate, disseminate law and regulations regarding assigned fields.
5. Manage quality and safety of fishery foodstuffs
a. Synthesize and submit to the Ministry the national monitoring program on food safety of fishery products in the stages of aquaculture, exploitation, harvest, preservation, dispatching, semi-processing, import for further processing, whole sale of fishery products; implement the program after being approved.
b. Submit to the Ministry national standards, technical regulations on the quality and safety compliance of establishments, group of establishments, sites of aquaculture, exploitation and harvest, ports, markets, vessels, collectors, dispatchers, preservators, processing and wholesale establishments.
c. Synthesize and propagate national standards, technical regulations, and requirements of international organizations, regions and importing countries on quality and safety of fishery products.
d. Check and certify or withdraw certification of health conditions concerning fishery foodstuff safety of aquaculture sites, fishing vessels, landing sites, markets, collectors, dispatchers, preservators, processing and wholesale establishments.
e. Check and certify the food safety of imported fishery products for further processing and domestically produced fishery products before export or domestic circulation.
f. Check and certify the animal health safety for imported, exported or transit fisheries according to Vietnam’s law, requirements of international organizations or bilateral arrangements with importing countries.

6. Management quality and safety of agro-forestry products and salt
a. Guide the relevant institutions to build-up, then verify and submit to the Ministry for issuing and oversee the implementation of supervising programs, national standards, technical regulations on quality, hygiene safety of agro-forestry products and salt.
b. Submit to the Ministry regulation on the verification and tracing back of the non-compliant consignments;
c. Synthesize and propagate Vietnam and international regulations on quality, hygiene safety of agro-forestry products and salt.
d. Propose and inspect according to annual plan or randomly approved by the Minister the hygiene conditions of manufacturers, establishments of cultivation, husbandry, slaughter collectors, dispatchers, preservators, slaughter-houses, processors and wholesalers of agro-forestry products and salt.
e. Check and certify for quality and hygiene safety of agro-forestry products and salt imported for further processing or domestically produced before export or domestic circulation according to Vietnam’s law, requirements of international organizations or bilateral with importing countries.
f. Verify and trace back contamination cause of agro-forestry products and salt and propose the Ministry the responsibilities of relevant institutions and put forward needed measures.

7. Management quality of non-food agro-forestry and fishery products
a) Submit to the Ministry programs, policy, national standards, technical regulations on the control of quality of non-food agro-forestry and fishery products.
b) Supervise, verify and propose the Ministry measures and methods to assure quality in the whole production chain of non-food agro-forestry and fishery products.
c) Check and certify for quality of non-food agro-forestry and fishery products imported for further processing or domestically produced before export or domestic circulation according to Vietnam’s law, requirements of international organizations or bilateral with importing countries.

8. Examination and testing
a) Synthesize and propagate Vietnam and international, region and importing countries’ requirements on testing criteria, limit of detection, testing and examining methods in the assigned fields.
b) Guide and supervise the testing activities of quality and safety of agro-forestry- fishery products and salt.
c) Build-up national reference laboratories for fishery quality and safety criteria; recognize national and international reference laboratories for quality and safety criteria of agro-forestry-fishery products and salt.
d) Supervise the implementation of national standards and technical regulations on the quality assurance system for laboratories of agro-forestry-fishery products and salt.

9. Build-up the network and evaluate, recognize the system of laboratories for agro-forestry-fishery products and salt testing; requirements and technical regulations on capacity, evaluation and recognition of accrediting bodies for quality and safety of agro-forestry-fishery products and salt; testing methods, reference testing methods, on-spot test kits. Taking part in the building up of the network of fishery disease examination.
